Terms of Service

These Terms of Service ("Terms") govern your use of moodspan.org(the "Site") operated by MoodSpan ("we," "us," or "our"). By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

1. Eligibility

You must be at least 13 years old to use the Site. By using the Site, you represent that you meet this age requirement. If you are under 18, you should use the Site only with the involvement of a parent or guardian.

2. Accounts

You may use much of the Site without an account. If you create an account via Google sign-in, you are responsible for maintaining the security of your account credentials. You agree to provide accurate information and to notify us if you believe your account has been compromised. We reserve the right to suspend or terminate accounts that violate these Terms.

3. Acceptable Use

You agree not to:

• Use the Site for any unlawful purpose or in violation of any applicable law
• Attempt to probe, scan, or test the vulnerability of the Site or circumvent security measures
• Use automated scripts, bots, or scrapers to access the Site or extract content at scale
• Interfere with or disrupt the Site or its infrastructure
• Impersonate any person or entity, or misrepresent your affiliation
• Attempt to extract, reverse-engineer, or reconstruct Aura's system prompts, model configuration, or internal instructions
• Use Aura to generate content that is harmful, abusive, or intended to harm others

4. Subscriptions and Payments

MoodSpan offers optional paid subscriptions ("Pro") with additional features. Subscriptions are billed monthly through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel.

• Cancellation — You may cancel at any time from your account settings. Cancellation takes effect at the end of the current billing period. No partial refunds are issued for unused time.
• Price changes— We may change subscription pricing with 30 days' notice. Continued use after a price change constitutes acceptance.
• Refunds — Refund requests are handled on a case-by-case basis. Contact contact@moodspan.org.

5. Intellectual Property

All content on the Site — including articles, screener implementations, design, code, and Aura responses — is owned by MoodSpan or its licensors and is protected by copyright and other intellectual property laws.

• You may read, share links to, and quote brief excerpts from our articles for personal, educational, or non-commercial purposes with attribution.
• You may not reproduce, redistribute, or republish substantial portions of our content without written permission.
• Screening instruments (PHQ-9, GAD-7, PCL-5, etc.) are reproduced under their respective public-domain or open-access licenses.

6. AI-Generated Content

Aura generates responses using retrieved clinical content and a large language model. While we design Aura to be accurate and clinically grounded:

• Responses may contain errors, omissions, or outdated information
• Aura cannot diagnose conditions or prescribe treatment
• Responses are not a substitute for professional clinical judgment
• We make no warranty regarding the accuracy, completeness, or suitability of AI-generated responses for any particular purpose

7. Limitation of Liability

To the fullest extent permitted by law, MoodSpan and its creators, contributors, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site, including but not limited to:

• Decisions made based on information or screening results from the Site
• Reliance on AI-generated content from Aura
• Inability to access the Site or loss of data
• Unauthorized access to your account

Our total liability to you for any claim arising from your use of the Site shall not exceed the amount you paid us in the 12 months preceding the claim, or $50, whichever is greater.

8. Disclaimers

The Site is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components.

9. Indemnification

You agree to indemnify and hold harmless MoodSpan and its creators from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Site or violation of these Terms.

10. Governing Law

These Terms are governed by the laws of the Province of Ontario, Canada, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Ontario, Canada.

11. Modifications

We may revise these Terms at any time by posting an updated version on this page. Material changes will be announced via the Site. Your continued use of the Site after changes constitutes acceptance of the revised Terms.

12. Termination

We may suspend or terminate your access to the Site at any time, with or without cause, and with or without notice. Upon termination, your right to use the Site ceases immediately. Sections that by their nature should survive termination (including disclaimers, limitation of liability, and indemnification) will survive.
